1. Acceptance of Terms

By accessing or using Pefoma's AI-powered inventory management platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users, including businesses, employees, and any individual accessing the Service.

2. Description of Service

Pefoma provides an AI-powered visual inventory management solution that enables businesses to count and track inventory using smartphone cameras. The Service includes mobile applications, web dashboards, API access, and related features as described on our website.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Payment Terms

Pefoma operates on a pay-per-count pricing model. By using paid features of the Service, you agree to:

  • Pay all applicable fees as described on our pricing page
  • Provide valid payment information (M-Pesa, MTN Mobile Money, Airtel Money, or card details)
  • Authorize us to charge your selected payment method for fees incurred

Prices are listed in Kenyan Shillings (KES) and may vary by region. We reserve the right to modify pricing with reasonable notice to users.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Share your account credentials with unauthorized parties
  • Use automated tools to access the Service without prior written consent

6. Intellectual Property

The Service, including its AI models, software, design, logos, and content, is owned by Pefoma and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of your inventory data and images uploaded to the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Offline features will continue to function during service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Pefoma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, you may request export of your data within 30 days.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
